State of New York County of Niagara Mary C. Lewis being duly sworn declared She is the same person who applied for a Mothers pension on account of the service and death of Wilson L. Starkey who was her son and has received a letter Dated Pension Office May 12, 1865 marked at bottom Vol 26/78, which requires among other things that Joel and Electa Stone testify they have no interest in the claim, and at what date the Soldier married their daughter and if they have any personal knowledge of his remitting money to his mother the dates and amounts. That she Deponent is not acquainted with either Joel or Electa Stone and never saw either of them. That she has endeavored to obtain information of their residence. That she has written to their former residence. That she has written to their former residence three different times the past spring and made diligent enquiry to learn their residence but has been unable to ascertain it. That her son married the daughter of said Joel and Electa Stone in one of the western states and Deponent never saw her sons wife but had letters from her That said son’s wife lived but a few months after her sons marriage. And her son took his said wife to her fathers in Illinois where she died. A few days after arriving at home. And said son did not live in the family of Joel or Electa Stone either had or was likely to have any personal knowledge of said son remitting money to his mother or the dates and amounts thereof, as required by said, letter. That neither said Joel or Electa Stone have any interest whatever in her claim for a pension That by reasons of the absence of said Joel and Electa Stone their being in some place unknown to Deponent she is unable to obtain their testimony as to the date her son married their daughter but refers to the affidavit of Joel C. Stone herewith forwarded to show the time of his daughters death. That the affidavit of Eliza Dunlap heretofore forwarded in the case was written in the presence of Deponent from the Statement made by her, and was read to her and explained to her, and was sworn to and subscribed by making her mark in Deponents presence. Mary C. Lewis Sworn to and subscribed by Mary C. Lewis this 3d day of July 1865 before me and I certify the statements of said Mary C. Lewis entitled to full credit, and I have no interest whatever in the aforesaid claim. J W Vail Justice of the Peace State of New York County of Niagara James F. Baldwin and Mary Jane Lewis being duly sworn declares the affidavit of Eliza Dunlap relative to claim of Mary C. Lewis for a Mothers pension on account of service and Death of Wilson L. Starkey was written by said James F. Baldwin from her statements and read and explained to her and thereafter sworn to and subscribed by said Eliza Dunlap in their presence by making her mark, and said Mary Jane Lewis says She has no interest whatever in said claim, and said James F Baldwin says he has no interest Whatever in said claim except that he is the claim agent employed therein and he respectfully submits that by the statutes of New York both the testimony of parties and persons in interest is admitted in New York Courts, and he further states that he knows of no one present at time of the execution of said affidavit of said Eliza Dunlap except said Mary C. Lewis and the two Deponents herein and Deponent’s wife and the Justice of the Peace. James F. Baldwin Mary J Lewis Sworn to and subscribed before me this 3d day of July 1865 by Mary Jane Lewis, and James F. Baldwin who are to me well known and credible persons and I certify the affidavit of Eliza Dunlap relative to Mary C. Lewis Claim for a Mothers pension was read and explained to said Eliza Dunlap previous to the execution thereof. Wright , County Clerk, and Clerk of the Courts of Records of said County, Do Certify that Job W. Vail , before whom the annexed Instrument in writing was proved or acknowledged, was at the time of taking the same, a Justice of the Peace in and for said County, duly authorized to take the same. And that I am well acquainted with his hand-writing, and verily believe the signature to the said Certificate is genuine. And that the annexed instrument is executed and acknowledged according to the laws of this State.
