This Indenture made the nineteenth day of October in the year of our Lord one thousand Eight hundred and thirteen Between Henry Huyck and Caty his wife a the Town of Tompkins County of Delaware and State of New York farmer of the first part and Caleb Smith of the Town, County, and State aforesaid of the Second part Witnesseth that the said parties of the first part and in Conssideration of the sum of one hundred dollars lawful money of the United States in hand paid by the party of the second part wherewith the said parties of the first part doth hereby declare themselves satisfied and paid hath and by these presents doth grant, bargain, sell, alien, release convey and confirm, unto the said party of the second part his heirs and assigns -- All that certain lot, tract piece or parcel of land lying and being in the Town of Tompkins and is known and distinquished in a map or survey |

thereof made by William Washburn among other lots by lot No 97 and begins at the south east corner of lot No 89. at a Beach tree cornered and marked 89. 90. 97 and 98 Running thence South two degrees and thirty minutes east thirty nine Chains and seventy links to a Beach tree cornered and marked 97. 98. 105. 106. thence South eighty seven degrees and thirty minutes west fifty chains to a (rooked?) Birch tree cornered and marked 97. 98. 104. 105 thence North two degrees and thirty minutes West forty Chains and ten links to a stake ten links from a Beech tree cornered and marked 88. 89. 96. 97. Thence North Eighty seven degrees and thirty minuts East fifty Chains and three links to the place of beginning the whole of said Lot containing one hundred and ninety eight acres and a half of land be the same more or less the one half of said lot we do hereby convey it being the North part of said lot of Land Togehter, with all and Singular the rights members and privileges to the same belonging or in anywise appertaining, and the reversion and reversions, remainder and remainders, rents issues and profits thereof And all the estate, right, title, interest, property, possession, claim and demand, both in law and equity, of the said parties of the first part, of in, and to the same To have and to hold, the said tract or parcel of land and premises, with the appurtenances, unto the said Caleb Smith his heirs and assigns, to his and their only proper use benifit and behoof, forever: And the said parties of the first part with for themselves their exectutors and administrators, covenant and agree to and with the party of the second part, his heirs and assigns, that they are the true and lawful owners of the said tract or parcel of land and premises with the appurtenances and are lawfully seized in their own right, of a perfect, absolute, and in defeasable estate of inheritence in fee simple of and in all the said premises, with the appurtenances, and hath in themselves good right, full power and lawful authority, to grant and convey the same in manner aforesaid - And also that he the said party of the second part his heirs and assigns shall and may, forever hereafter, peaceably have, hold, occupy and possess, the said grantese premises, free from the hinderence or molestation of any person or |

persons lawfully claiming the same And that they the said parties of the first part, and their heirs the said parcel of land, and premises unto the said party of the second part his heirs, and assigns against all claims and demands whatsoever shall and will warrent and forever by these parsents defend ~ In witness whereof the parties of the first part hath hereunto set their hands and seals the day and year first above written Sealed and delivered } In presents of } Henry Huyck {LS} Wyman Parker } Caty Huyck {LS} Simeon Goodman } State of New York Delaware County Ss: On the twentyth day of October in the year one thousand and eight hundred and thirteen before me came Henry Huyck and Caty his wife and severally acknowledged the within instrument to be their respective voluntory act and deed and that they respectively signed sealed and delivered the same to and for the uses and purposes therein maentioned and the said Caty being examined by me privately and apart from her said husband acknowledged the said instrument executed by her was done without any fear or compulsion of her husband and also appeared before me at the same time Wyman Parker a person to me known who being duly sworn made oath that he knowes the said Henry Huyck and Caty his wife and that they are the same persons described in and who executed the said deed and I being satisfied from the evidence of the said Wyman Parker that the said Henry Huyck and Caty his wife are the same persons described in and who executed the said instrument and having examined the said indenture and finding no erasures or interlinations therein are allow the same to be recorded Simeon Goodman one of the Judges of Delaware common pleas |
